Federal criminal defense lawyer Ryan Pacyga shares a lesson he learned that can benefit people facing a federal prison sentence. If the court allows you to be on pretrial release (instead of in jail while your case is going on), you will stay out of jail. Then, if you reach a plea agreement, you will have a sentencing hearing date. At that date, many times the law says you are supposed to be taken into custody at your sentencing hearing. But there are some ways around that. If the judge gives you permission to "self surrender," that could really help you out when the federal bureau of prisons classifies your security risk and what prison or camp they send you to. In addition, in this case I was happy to advocate for a 70 month sentence over the prosecutor's desire for the guideline sentence of 145 months. Some cases get dismissed or are won at trial, but others result in plea agreements where the challenge is then how much time to try to save the defendant.
