Mr. Orlando Harris was dismissed in January 2014 by Chefette Restaurants Limited. He had worked as a manager with the establishment. Mr. Harris filed a claim for unfair dismissal before the Employment Rights Tribunal (ERT), which held that his claim was well-founded and that he was entitled to compensation in the sum of $106,630.01. The Court of Appeal of Barbados upheld the findings of the ERT on appeal but adjusted the award to $95,089.13 because he had been given payment in lieu of notice by Chefette. Chefette was then granted leave to appeal to this Court by the Court of Appeal on November 16, 2017, with its Certificate of Compliance with that Order dated May 6, 2019.
