But Lewis and Clark College in Portland, Oregon, separated black, white, and “indigenous/people of color” during a mandatory student orientation workshop — even though a professor warned administrators against it. In a letter to the college, the Foundation for Individual Rights in Education wrote that providing “differing educational experiences to students on the basis of their race is not only unconscionable but also unlawful.” “It is settled law that—regardless of purpose or intent—colleges like Lewis & Clark may not require students to identify themselves by race or ethnicity and then use those classifications to deliver separate educational resources or experiences to its students.” Lewis & Clark disputes FIRE’s claims that the workshop was mandatory, even though the orientation schedule plainly says it’s “Mandatory for all new students” and the program’s registration form “required” students to select their identified race from a drop-down menu. Lewis & Clark did pledge to “be clearer” in the future that such programs — if it chooses to use them again — would be optional. But Lewis & Clark’s response ignores the clear fact: race-based segregation is wrong.
