“Common sense shows the answer is to pay for the idea.” - Attorney Rob McKinley, who represents The Jacks NYB on the Blues paying the bar for starting Gloria. I’m sure most of you know the story but if not, here’s a quick synopsis. The struggling Blues adopted the song on January 6th after eating the Eagles’ NFC wild-card game against the Bears. The team loved the song so much when it came on the jukebox they decided to keep it playing over and over. Joel Edmundson said, “right there we decided we should play the song after our wins.” The Jacks NYB filed a trademark application May 8th with the U.S. Patent and Trademark Office for “Play Gloria” and filed a second application June 1st for “Play Gloria!” McKinley goes on to say that, “Anheuser-Busch and the St. Louis Blues don’t use ‘Play Gloria!’ because they understand how this works, they’re sophisticated companies.” McKinley goes on to state, “ It’s some of the smaller companies that are making enormous profits.” Should the St. Louis Blues pay The Jacks NYB bar a percentage for the Gloria merchandise?
