Prudent Media Goa's video: Is swearing-in of MLAs before Govt formation permitted as per Constitution of India

For the first time in the history of Goan politics, MLAs have been sworn in before the government, as there is a lack of clarity yet as to who will be the next Chief Minister of the state.  However, the question that comes to the minds of people is “Is this permitted as per the Constitution of India?”. Prudent spoke to Goa’s leading legal experts and sought their opinion on the same.   Political analyst Adv Cleofato Almeida Coutinho said “This is not a major breach, but it is not correct, why should the government wait for auspicious days,”  Lawyer Yatish Naik is of the opinion that the swearing in of MLAs before the government is well within the law. “What has happened today is that the last assembly came to an end, so the new assembly has been constituted and the oath has been given to the MLAs today. There is nothing that is an anomaly of that sort,” he added Although unprecedented, it is quite clear that it is not unconstitutional.
