Sparrow | 287 S.W.2d 583 (1956) Ranch hands and rodeo riders pride themselves on their skill at lassoing calves from horseback. The horse is a vital member of the roping team. Morris versus Sparrow is the story of a dispute between a ranch owner, a cowboy, and a freshly trained roping horse named Keno. Archie Sparrow was a cowboy and horse trainer. He met Morris at a rodeo in Florida. Morris invited Sparrow to come work at his cattle ranch in Arkansas. The two men agreed that Sparrow would work on the ranch for 16 weeks while Morris went to Canada. Morris would pay Sparrow $400 for this work. As additional consideration, Sparrow was to receive a brown horse named Keno. Keno was practically unbroken. While Morris was in Canada, Sparrow trained Keno, who shaped up into a first-class roping horse. When Morris got home, he wrote Sparrow a check for $400 on which he wrote the words, quote, “labor paid in full,” unquote. While the men were at the bank exchanging the check, Morris said he’d give Keno to Sparrow on the condition that Sparrow not sell or dispose of the animal. Sparrow refused to agree to this. Morris then announced that handing over Keno was contingent on Sparrow having done a good job with his work on the ranch. He declared that Sparrow’s performance had in fact been unsatisfactory and refused to relinquish the horse. Sparrow sued Morris in equity for specific performance, seeking to get Keno. The chancery court found that Sparrow had done a good job on the ranch, regardless of what Morris claimed, and ordered Morris to hand over the horse. Morris appealed to the Arkansas supreme court. He argued that an action in equity couldn’t require him to deliver the horse, and that his check to Sparrow was payment in full for everything he owed, as proven by his notation on the check.
